General Terms and Conditions (GTC)

1. Overview
This website is operated by QOQO cosmetics Shop. Throughout the text, the terms "we," "us," and "our" refer to QOQO cosmetics Shop. We provide this website, including all information, tools, and services available herein, to you on the condition that you accept all terms, policies, and notices stated here.
By visiting our website and/or purchasing a product from us, you make use of our "Service" and agree to the following General Terms and Conditions ("GTC"), including any additional terms and policies referenced herein and/or available by hyperlink.
These GTC serve as a legal safeguard for both us as the operator of the online shop and for you as the customer. They cover all essential provisions regarding business processes, contract formation, payment terms, shipping, withdrawal, warranty, and data protection. Our GTC are designed to take into account both consumer customers (B2C) and business customers (B2B).
Please read these GTC carefully before placing an order or using our website.
2. Scope and Conclusion of Contract
These GTC apply to all contracts concluded between you as the customer and us as the operator of the online shop. Our offers on the website do not constitute binding offers but serve merely as information. A binding contract is only concluded once we expressly accept your order or dispatch the goods to you.
Our website allows you to purchase various products. However, the display of products does not constitute a legally binding offer but rather a non-binding invitation to place an order. By completing an order through our website, you submit a legally binding offer to purchase the selected products. We confirm receipt of your order by email. However, a contract is only formed when we either expressly accept the order or dispatch the goods to you.
We reserve the right to refuse orders without stating reasons. This may particularly occur if the ordered products are unavailable, payment issues arise, or there is suspicion of fraudulent purchases.
3. Prices and Payment Terms
All prices listed on our website are final prices in euros, including statutory VAT. Additional costs, such as shipping charges, will be displayed separately during the ordering process and shown to the customer before the order is completed.
We offer various payment methods, including credit card, PayPal, instant bank transfer (Sofortüberweisung), prepayment, and purchase on account. Payment is due immediately upon completion of the order unless otherwise agreed.
If a payment is not properly made or is reversed, we reserve the right to charge default interest at the statutory rate. In such cases, reminder fees may also be charged to cover the additional administrative effort.
4. Delivery and Shipping
Delivery is made within Germany and the European Union. The regular delivery time is three to seven working days, unless otherwise stated on the product page. We always strive to process and dispatch orders as quickly as possible. Should delays occur, we will inform you in good time.
The ordered goods will be sent to the delivery address provided by you during the ordering process. It is your responsibility to ensure the accuracy of the address details. If delivery cannot be made due to incorrect address details and additional costs are incurred, these are to be borne by the customer.
We accept no liability for delays caused by third parties such as shipping service providers. Once the goods have been handed over to the shipping company, the risk of transport passes to the customer.
If an ordered product is no longer available, we reserve the right to cancel the order. In such cases, we will inform the customer immediately and refund any payments already made.
5. Right of Withdrawal and Returns
As a consumer, you have the right to withdraw from the purchase contract within 14 days after receiving the goods without giving any reason.
The withdrawal period begins on the day you, or a person authorized by you, take possession of the goods. To exercise your right of withdrawal, you must send us a clear declaration of your decision to withdraw, either by email or by post.

Goods must be returned within the withdrawal period in unused, undamaged, and original packaging. Return costs are borne by the customer, unless otherwise agreed.
6. Warranty and Disclaimer
We strive to provide you with products of flawless quality. However, if a product is defective, the statutory warranty rights apply. Liability for material defects is excluded if the buyer does not inspect the goods immediately upon receipt and fails to report obvious defects in writing within seven days.
Our liability is limited to intentional or grossly negligent breaches of duty, as well as damages resulting from the breach of essential contractual obligations. For slight negligence, we are only liable for breaches of obligations that enable the proper execution of the contract in the first place. In such cases, liability is limited to foreseeable damages.
7. Liability for Transport Damage
The risk of accidental loss or deterioration of the goods passes to the customer upon handover to the shipping company. If the goods are damaged or lost during transport, it is the customer’s responsibility to report the damage to the shipping company immediately.
The customer must check the goods immediately upon receipt and report obvious transport damage in writing within 24 hours. If transport damage is not reported in time, claims against the shipping company can no longer be made. We will support our customers in resolving such issues with the shipping service provider to the best of our ability.
8. Data Protection
The protection of your personal data is important to us. Processing is carried out in accordance with statutory data protection provisions. We process personal data exclusively for the purpose of contract execution and compliance with legal obligations.

9. Special Provisions for Business Customers (B2B)

Business customers are obliged to pay all invoices within the agreed payment period. If the customer defaults on payment, we are entitled to charge statutory default interest. In addition, we reserve the right to charge reminder fees or block the customer from future orders.
The purchase contract for the products is concluded exclusively between the business customer and QOQO CARE UG. QOQO cosmetics Shop merely acts as the platform intermediary and assumes no warranty or liability for the delivered products.
10. Final Provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
The place of jurisdiction for disputes arising from this contract is our registered office, provided the customer is a merchant.
Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall not be affected. Instead of the invalid provision, a statutory provision shall apply that comes closest to the economic purpose of the invalid provision.
